Overview
The project consisted of the demolition and clearance of a former commercial garage (undertaken via a separate contract) including the isolation of existing services and the removal of all hardstanding and outbuildings. Then the construction of 14 new (4-bed) dwellings with all associated external works, the dwellings were a mixture of private and HMOs. However, at an early stage of the contract, there were changes so that all dwellings were private, with 8 having the relevant infrastructure in place for future proofing to convert into HMOs.
Costplan’s Involvement
The project had a boundary dispute, which only became evident once work commenced. The dispute arose when the contractor erected site hoarding as per the red line boundary drawings provided. As the contractor had taken down the existing fencing, which was not as per the red line drawings, the neighbour disputed that his fencing had been installed for over 12 years and was undisputed, therefore the legal possession of the land transferred to them. Unfortunately for our client, this was correct and resulted in the loss of land from the proposed development gardens.
